Rob Kardashian’s social media rampage against his ex-fiance took center stage in an LA courtroom today. Blac Chyna has granted a temporary restraining order against him. It is one of the highest profile cases of alleged revenge porn. Here to discuss is top family law attorney Christopher C. Melcher of Walzer Melcher. Can you tell us about the states non-consensual pornography law passed in 2013. What kind of punishment are we talking about?
“There could be some jail time, maybe up to 6 months if there’s a non-consensual distribution of sexually explicit photographs by a partner,” explains Christopher C. Melcher, a top divorce attorney in California.
What kind of punishment could Kardashian face?
“The potential would be 6 months in jail although that type of crime may not end up doing a lot of time in jail. I think that the restraining order that was issued against him is the most serious punishment that would come out of it,” states family law expert Christopher C. Melcher.
What would this restraining order do?
“It would prevent him from doing further acts of abuse and stalking her, cyberbullying- that type of conduct would be prohibited now,” explains top family law attorney Christopher C. Melcher.
Let’s talk about revenge porn. Is it on the rise? Or are more well-known people becoming more aware of it?
“It’s happening more often. It’s easier to take photographs and videos, and easier than ever to share them. These types of things are happening and when you have someone that breaks up a relationship and is spiteful-this is happening,” Melcher explains.
Any advice to people at home besides not taking videos like that?
“There’s nothing private anymore,” states divorce lawyer Christopher C. Melcher. “It can affect settlements sometimes, but really it affects the child. This couple has a child and this can do long-lasting damage to the child more than the parties.”
Speaking of that little girl, what are some of the damages? Does the restraining order bear an impact on the child custody rights between the parents? How does that work?
“The next issue would be child custody and visitation issues to work out between the parties. This type of conduct could have a bearing on access to his child,” states family law attorney Christopher C. Melcher.
