Description:
The family court modified a child custody and child support order issued by a North Carolina court, without first determining whether the California court had jurisdiction under the Uniform Child Custody Jurisdiction and Enforcement Act (UCCJEA) in Family Code section 3400 et seq. There was no jurisdiction in California under the UCCJEA to modify the custody order because there was a pending action in North Carolina and the father resided in North Carolina. The California court was required to stay its proceedings and communicate with the North Carolina court per Family Code section 3426, subdivision (b).
