Alec Baldwin is now looking at a civil trial over the Rust movie set shooting. A judge in LA set a trial date for October in the case of a gaffer who sued Baldwin. The gaffer was on the set at the time Baldwin accidentally shot cinematographer Halyna Hutchins back in October 2021. He’s suing, claiming Baldwin was negligent in handling the gun and that he suffered emotional distress as a result, even though he wasn’t hurt. We asked celebrity Attorney Chris Melcher how the gaffer would show a jury he suffered emotionally.

Did he go to counseling or therapy? Was he unable to sleep? How did this cause him to suffer emotionally? And it’s really going to come down to how well he can articulate that, how disruptive that was to his life, and how credible these things are.

Melcher says if a jury signs with the gaffer, it has wide discretion on how much money to award. It could award $1 million or $1. Though Melcher says there could be a settlement because the trial date was pushed back to October, so both sides could work on reaching some kind of deal.

Alec Baldwin could be headed to a civil trial later this year over the Rust movie set shooting. A judge in LA today ordered him to face trial. This will be in October now. A gaffer on set sued Baldwin for negligence, claiming emotional distress over the accidental shooting of cinematographer Halyna Hutchins. This happened back in 2021. The gaffer was not hurt though. Celebrity attorney Chris Melcher says the gaffer’s side will have to show Baldwin didn’t use proper care in handling that gun.

The plaintiff needs to show that it’s more likely than not that he suffered emotional distress damages a result of this incident. And the jury would have to then also be convinced that the amount of damages that he’s seeking is reasonable or credible. But the jury has a tremendous discretion. It could say, yes, all this happened and emotional distress was suffered and here’s $1.
