I’m now with high net worth divorce lawyer Chris Melcher. He practiced criminal defense law and is a celebrity legal analyst. Thank you for joining us Chris. Nathan Wade gone. He’s done. Does the rest of the prosecutorial team stay intact and will a trial come soon since they might stay?
Georgia DA’s Continue to Prosecute
Chris Melcher:
Well, sure. The prosecution is going to continue. The Georgia DA’s office is still there prosecuting it, but she did need a special counsel to assist because when you have these bigger cases, a lot of times the prosecutor office doesn’t have the resources. So the question now is, will she have to go out and find another special prosecutor? Nathan Wade was not her first choice. There was another person that she checked with and who rejected it. So now it’s really going to have to be up to her to determine whether she would bring somebody else in and who would really do that role, or would she try and do it herself with the district attorneys that she has in her office.
Chance Seales:
How long would that take?
Chris Melcher:
Well, it’s certainly going to disrupt the case, but her office has been involved, so it’s not like she completely delegated the entire prosecution over to Nathan Wade. So I do think that they could keep moving forward, but if a special prosecutor would be appointed, then obviously that person needs to get up to speed and then there could be questions of that person’s motivations and anything in their background that could be disqualifying. So this is kind of yet to be seen how they’re going to move forward from today.
Chance Seales:
Chris, I want to get your analysis of something that Ava-Joye just mentioned right there, that defense attorneys are complaining that the judge kind of overlooked Fani Willis‘ impropriety by going to a black church and claiming that all these objections are really about taking down a powerful black man, powerful black woman. Was that proper?
Judge AcAfee’s Gag Order
Chris Melcher:
Well, the judge was critical about the comments that Fani Willis had made, and there are some ethical restrictions on what attorneys and prosecutors can say about a pending criminal case, and that’s all for the protection of the accused. So the judge was highly critical of making these comments because the defendants are entitled to a fair trial. And there were some questions here about her statements as to whether the defendants could get a fair trial now, based on what she said. The judge said that he’s open to a gag order. So if someone were to make a motion before Judge McAfee, it sounds like he’s inclined to grant an order restricting speech by any of the attorneys regarding the case. There could also be a referral to the Georgia State Bar for disciplinary action based not only on the comments that were made, but also by having this intimate relationship with the subordinate during the case.

So it seems like things can move forward. We don’t exactly know who’s going to head this up. If Donald Trump were your criminal defense client, what would your next tack be?
Trump Wants to Delay Trial
Chris Melcher:
“Well, I think with Donald Trump, he wants to delay this obviously until the election is over and this could very well do it. I think that the appeal that has been talked about is unlikely, because Judge McAfee is a very careful lawyer. I did read the 23-page decision and was impressed by it. I don’t believe that a court of appeal would overturn it, so I don’t think that would be the angle that I would choose. I think it would be more on questioning whoever this new special counsel is, because they are being paid to prosecute a case. And that’s always a problem inherently with a special prosecution appointment. Unlike a regular prosecutor is getting a salary and has no financial incentive tied to the case, special prosecutors do. They’re getting paid by the hour. So I got to imagine all the defendants here are going to continue that attack,” stated top family law attorney Christopher C. Melcher.
Chance Seales:
I was going to ask you how you felt about the judge in this case because he’s first of all, 34 years old, he used to report to Fani Willis in another professional life and the intense, I mean, crazy amount of public scrutiny and glare is there. And you said he’s doing a pretty good job at this point.
